GENERAL TERMS AND CONDITIONS

The following rules comprise Regulations of the online shop Djenka.pl at www.djenka.pl. The Regulations are binding for the Seller and all the Customers who use the Shop at the aforementioned website.

All products offered by the  www.djenka.pl shop are free from any physical or legal faults and have been legally

introduced to Polish market.

The www.djenka.pl Shop sells items via the Internet.

 

ORDERS

To place an order Customers should register at the Shop's website providing necessary information.

Orders can be placed through the website www.djenka.pl. Once the order has been placed, Customers will receive an e­-mail confirmation of the order.

Placing an order is tantamount to accepting the terms and conditions of the Shop Regulations.

Orders will be processed provided the items are available from stock. In the event that the items are unavailable, the Customer will be informed of the order status and will decide about the order's further processing (partially processing the order, extending waiting time, cancellation of the whole order).

If requested, a VAT invoice will be issued. A VAT invoice is issued, when all the ordered items have been assembled and ready to dispatch. Customers should request an invoice immediately (not later than 24 hours after the order has been placed). The invoice should be kept in case of later returns or complaints.

Customers may edit their orders until the Seller sends an e­mail confirmation of the order. All prices include VAT. The items are sold at a price quoted at the time of order placement.

The Seller reserves the right to change prices quoted in the offer, add new products to the Shop’s offer, as well as introduce, change and cancel promotional actions on the Shop’s website.

 

DELIVERY

Purchased items are delivered either by Poczta Polska (Polish Postal Service) or by other courier services operating in Poland. Delivery fees vary depending on the size and weight of the package. Delivery costs include courier charges for delivery and the cost of packaging. Total cost of delivery is displayed at the time of order placement.

Orders are processed within 3 working days after receipt of payment by the Seller.

The Seller will not be responsible for failure to comply with the deadlines due to reasons beyond the Seller’s control, especially due to Force Majeure. If the Seller is unable to fulfil an order within time period indicated on the website, they will immediately inform the Customer of the reasons thereof and specify new, estimated processing time. In that case the Customer will be entitled to cancel an order.

 

RETURNS AND COMPLAINTS

Pursuant to article 7 of Act of March 2, 2000 on the Protection of Certain Consumer Rights and on the Liability for Damage caused by a Dangerous Product (Journal of Laws 2000.22.271), Customers have the right to cancel the purchase without providing reasons for cancellation – within 10 days of receiving ordered items. Items returned on this basis will only be accepted by the Seller if they are sent back in its original, undamaged packaging, with all the contents (product, tag, receipt), in brand new condition. All returns must be accompanied by a written statement of withdrawal from a contract together with information of the Customer’s bank account number. The Seller will then return the payment to the indicated bank account within 14 days. The Shop guarantees return of the payment equal to the selling price of the item. The costs of dispatching the returned or exchanged items will be covered by the Customer.

 

If Customers discover physical or delivery­related damages of the received items, they are obliged to immediately inform the Seller (at kontakt@djenka.pl) of the type of defect or damage discovered. The Seller will process the complaint within 14 working days from the date of its receiving. Damaged goods should be sent back to the Shop’s address. A damaged or faulty item will be exchanged for a new one, if possible. If the exchange is impossible (e.g. due to the items being out of stock), the Seller will refund full price of returned goods or offer different, available items for the Customer to choose from. The Seller will refund the costs of dispatch of the damaged or faulty goods, provided the Customer indicates their bank account number.

 

PERSONAL DATA PROTECTION

Pursuant to the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws, 2002.101.26 as amended), The Seller covenants, that the Customers’ personal data are protected. By placing an order, Customers voluntarily consent for their personal data to be processed and used for the purposes of the order fulfillment, possible complaints, facilitation of future orders placement and for advertising purposes. Customers’ personal data will not be processed or used for any other purposes.

Your personal data are being controlled by Djenka Joanna Kocur, ul. Bratków 4, 43-200 Pszczyna, NIP: 638-126-91-84, who processes personal data in accordance with the Act of August 29, 1997 on the Protection of Personal Data and the Act of July 18, 2002 on Rendering Electronic Services – solely for the purposes of user registration and proper provision of the services.

You have the access to your personal data, as well as the right to amend them or demand their removal. Submitting personal data is voluntary. The personal data controller Djenka Joanna Kocur uses cookie files to collect statistical data and adjust the Shop website’s content to the user’s interests.

 

COPYRIGHT PROTECTION

The website’s djenka.pl content is protected by copyright. Content, photographs and graphics published by their authors constitute a work as defined by the Act of February, 1994 on Copyright and Related Rights and are protected pursuant to that Act.

Damages connected with illegal use of copyrighted materials (whole or in part) will be recovered under the provisions of the Act of February 4, 1994 on Copyright and Related Rights and the Act of April 16, 1993 on Combating Unfair Competition.

 

FINAL PROVISIONS

These regulations take effect February 21, 2014. The Regulations may be amended at any time. Amendments will not adversely affect Consumers’ rights and obligations relating to the services being already rendered. Amendments to the Regulations take effect from the date of publishing them on the djenka.pl website.

To all matters not settled herein, generally applicable law shall apply, especially provisions of the Civil Code, the Act on Specific Terms and Conditions of Consumer Sale and Amendments to the Civil Code and the Act on Protection of Certain Consumer Rights and on the Liability for Damage caused by a Dangerous Product.

All the names of items offered for sale by the Online Shop are used for identification purposes and can be protected and trademarked pursuant to the Act of June 30, 2000 on Industrial Property Law.
